What types of “contracts” are available to address family law issues?

Separation Agreements are contracts that address issues arising from the breakdown in a relationship. Separation Agreements require the parties to work through their disputes in an amicable fashion. In some cases, both parties may work directly with one lawyer to complete a ‘collaborative separation agreement’. 

Domestic Contracts are sometimes referred to as ‘Prenups’ or ‘Postnups’. These agreements are made between parties to agree to terms concerning their separation, in the unlikely event it may happen. These agreements can include terms relating to property, support, a family business, non-family businesses, and parenting issues. 

Cohabitation Agreements are used to assist common law couples to agree on the terms of their cohabitation. Terms can include contributions to common expenses, entitlement to property, agreements about the prospect of spousal support, and issues related to the parties’ children.
